DMCA Takedown Policy

2. Submitting a DMCA Takedown Notice

If you are a copyright owner (or authorized agent) and believe that content on Magik Face infringes your copyrighted material, you must submit a written takedown request that includes:

• Identification of the copyrighted work you claim has been infringed.
• Identification of the infringing material on Magik Face, including a direct URL or detailed description of its location.
• Your contact information, including your full name, email address, phone number, and mailing address.

• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

3. Counter-Notification Process

If you believe that content you generated on Magik Face was wrongfully removed in response to a DMCA notice, you may submit a DMCA Counter-Notice, which must include:

• Identification of the material that was removed and the location where it previously appeared.
• A statement, under penalty of perjury, that you have a good faith belief that the content was removed due to mistake or misidentification.
• Your contact information, including your full name, email address, phone number, and mailing address.
• A statement that you consent to the jurisdiction of the federal district court in your location (or where Magik Face operates) and that you will accept service of process from the party that submitted the takedown request.
• Your physical or electronic signature.

Once we receive a valid counter-notice, we may restore the removed content unless the original complainant files a lawsuit within 10 business days.

4. Repeat Infringer Policy

• Users who repeatedly upload content that violates copyright laws may have their accounts suspended or permanently banned.
• We reserve the right to terminate user accounts at our discretion if they violate this policy.

5. Limitations of Liability

• Magik Face acts as a service provider and is not responsible for user-generated content.
• We process DMCA claims in good faith but are not liable for misfiled, false, or inaccurate copyright claims.
• Users who submit false DMCA notices or counter-notices may be subject to legal penalties under 17 U.S.C. § 512(f).

6. Changes to this DMCA Policy

Magik Face reserves the right to update or modify this DMCA policy at any time. Significant changes will be communicated through platform notifications or email.
