Magik Face is exclusively intended for the creation and manipulation of virtual models and characters. The service is not designed or permitted for the generation, imitation, or reproduction of real persons' images, voices, or identities.

3. Prohibited Content

You are strictly prohibited from using Magik Face for:

• Any content involving minors (individuals under 18 or the age of majority in their jurisdiction)
• Generation, imitation, or reproduction of real persons' images, voices, or identities
• Non-consensual impersonation or identity theft
• Any illegal activities or content that violates applicable laws
• Content that promotes hate speech, violence, or discrimination

4. User Content Rights

By uploading any content to Magik Face, you confirm and warrant that:

• You own or have obtained all necessary rights, licenses, and permissions to use and authorize Magik Face to use the content
• Your content does not infringe upon any third party's intellectual property rights, privacy rights, publicity rights, or other rights
• You have obtained explicit consent from any identifiable individuals featured in your content
• You accept full legal responsibility for any content you upload or generate using our services

5. Intellectual Property

All content and materials available on Magik Face, including but not limited to text, graphics, logos, images, and software, are the property of Magik Face or its licensors and are protected by applicable intellectual property laws.

6. Uploaded Images and User Rights

Users must have the legal rights to any images they upload to the platform. By uploading an image, you represent and warrant that you are the rightful owner or have obtained explicit permission. Violation may result in removal of content, suspension or termination of your account, and reporting to relevant authorities.

7. Payment and Refund Policy

Payments for rubies or services are non-refundable, except in cases of double billing or technical errors, or failure to provide the intended service. Refund requests must be submitted within 14 days of purchase.

8. Disclaimer of Warranties

Magik Face provides its services "as is" and without any warranty or condition, express, implied or statutory. We do not guarantee the accuracy, completeness, or reliability of any content or materials available on our platform.

9. Limitation of Liability

In no event shall Magik Face be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Hong Kong SAR.

11. Changes to Terms

Magik Face reserves the right to modify these Terms of Service at any time. We will post the most current version on our website, and your continued use after any changes constitutes your acceptance of the new terms.

12. Affiliate Payment Policy

Commissions will not be paid on transactions that are refunded, charged back, or canceled. Affiliate commissions are only paid on eligible top-up credit purchases. MagikFace Memberships, discounted bundles, subscriptions, and promotional offers are not commissionable. Affiliate payouts are processed on a Net-30 basis (30 days after a successful, eligible purchase), and only after a valid invoice is submitted by the affiliate. MagikFace reserves the right to review and adjust commissions at its sole discretion if abuse, fraud, or error is detected.
